The website ybera-groupe.com is the property of SAS MCB in its totality, as well as all the rights related to it. Any reproduction in whole or in part is systematically submitted to the authorization of the owners.
The general conditions of sale have for object to frame the sale between the site ybera-groupe.com and the customer.

Acceptance of the General Conditions of Sale 

The customer acknowledges having read at the time of placing the order, the general conditions of sale, and declares to accept them without reservations.
These General Conditions of Sale govern the contractual relationship between YBERA-GROUPE.COM and its customer, both parties accepting them without reservation.

Controls 

The automatic recording systems are considered as proof of the nature, content and date of the order.
YBERA-GROUPE.COM will confirm the acceptance of the order to the customer at the email address that it will have informed, the sale will then be said concluded.
YBERA-GROUPE.COM reserves the right to cancel any order from a customer with whom there is a dispute relating to the payment of a previous order, or any order with an abnormal character including with aberrant quantities.
The information stated and entered by the buyer on the site YBERA-GROUPE.COM, when taking the order, engage it in case of error in the wording of the recipient, the seller can not be held responsible for the impossibility in which it could be to deliver the order.

Products

The photographs illustrating the products are the property of SAS MCB and may not be used by a third party.
These photographs are proposed as an indication and have no contractual character.
The majority of products offered on YBERA-GROUPE.COM are available in stock.
Any promotion offered on YBERA-GROUPE.COM is valid "While stocks last".
The products offered are in accordance with the French legislation in force and the standards applicable in France and in the European Union.
All products offered on YBERA-GROUPE.COM come from the manufacturer or its distributor.
YBERA-GROUPE.COM undertakes not to sell counterfeit products.
The customer agrees to return within 48 hours from receipt of an email alert, at the expense of YBERA-GROUPE.COM, all products that YBERA-GROUPE.COM could ask the customer to return. (Withdrawal of the product by the manufacturer, by the health authorities etc. ....).
The product will then be exchanged by another or equivalent or refunded to the customer within 21 to 30 days by check.
If the customer does not respect the procedure, YBERA-GROUPE.COM declines any responsibility on the possible damages which could occur, and the customer will be able then to foresee himself of no damages or indemnities that it is.
The transfer of ownership of products is expressly subject to full payment of the price. This clause does not prevent the transfer to the buyer of the risks of loss or deterioration as well as the damage that it could cause.

Price

The price is expressed in euros.
The price indicated on the "product sheets" does not include transport.
The price indicated in the confirmation of order is the final price, expressed all taxes included and including the VAT for France and the countries of the EEC. It includes the price of the products, the handling, packaging and conservation costs of the products, the transport and commissioning costs.

Payment

The price charged to the customer is the price indicated on the order confirmation sent by YBERA-GROUPE.COM.
The price of the products is payable in cash on the day of the order.
Payment is made by credit card bearing the CB symbol.
The online payment will be made via a CIC bank server in a secure environment.
Your credit card number is therefore directed to the bank's servers, your payment is made directly to a bank in a secure environment without going through the server of the store, a guarantee all the more important as your numbers are known only to our banking partner.
The order validated by the customer will be considered effective only when the banking payment centers concerned have given their agreement. In case of refusal of the said centers, the order will be automatically cancelled and the customer will be informed by e-mail. In addition, SAS MSC, reserves the right to refuse any order from a customer with whom there is a dispute.
We do not keep the data relating to the bank cards of our customers following the payment.

Warranty (non surcharged service)

If, upon delivery, the product shows defects or is damaged, the customer has a period of 7 days to return the goods in their original packaging without the product having been damaged or its original packaging deteriorated, for an exchange or a refund.
The returned product will have to be intact, unused and include its possible notices, documentations or accessories which accompany it.
As far as food is concerned, the consumption dates indicated must be respected by the customer.

In case of problem on a product which would not correspond to the ordered product, the return will be done only by Collissimo France. The shipping costs will be reimbursed to the customer (in loyalty point) according to the rates applied by Collissimo. A copy of the proof of shipment with rate and tracking number will be requested from the customer.
In all cases SAS MCB can not be held responsible for non-compliance with regulatory and legislative provisions in force in the country of receipt, the responsibilities of SAS MCB is systematically limited to the value of the product in question, value at the date of sale and without recourse to the brand or company producing the product.
In any case, the customer benefits from the legal guarantee of eviction and hidden defects (Art.1625 and following of the Civil Code). On the condition that the buyer proves the hidden defect, the seller must legally repair all the consequences (Art.1641 and following of the civil code). If the buyer goes to court, he must do so within a "short period" from the discovery of the hidden defect (Art.1648 of the civil code). Delivery

The preparation of the order and its delivery can only be carried out once the order has been paid for by the Customer. The products are delivered to the delivery address indicated during the ordering process, within the time indicated on the order validation page. The orders are made by La Poste via COLISSIMO, delivery service with tracking (with or without signature or in a collection point). Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be terminated and the buyer reimbursed.

Withdrawal (non surcharged service)

The customer has a period of 7 days from receipt of the items to make an opinion. In case of exchange or refund the customer will have to send back the goods in their original packaging without the product having been damaged or its original packaging deteriorated.
The returned product must be intact, unused and with any accompanying instructions, documentation or accessories.

In case of exercising the right of withdrawal SAS MCB is obliged to reimburse the sums paid by the customer without charge.
The goods must be returned in their entirety and in new condition at the customer's expense, the refund will then be due within a maximum of 30 days from receipt of the goods.
If the customer wishes an exchange of products, the new products will be sent at the expense of the customer, upon receipt of those that were not suitable.

Litigation

This contract is subject to French law, SAS MCB, can not be held liable for damages of any kind, both material and immaterial or physical, which could result from a malfunction or misuse of products sold. The same applies to any modifications to the products resulting from the manufacturers. The responsibility of SAS MCB will, in any case, be limited to the amount of the order and cannot be held liable for simple errors or omissions that may have occurred despite all precautions taken in the presentation of the products. In case of difficulties in the application of this contract, the buyer has the possibility, before any legal action, to seek an amicable solution, in particular with the help of: a professional association of the branch, an association of consumers or any other council of his choice. It is reminded that the search for an amicable solution does not interrupt the "short period" of the legal guarantee, nor the duration of the contractual guarantee. It is reminded that as a general rule and subject to the appreciation of the Courts, the respect of the provisions of the present contract relating to the contractual guarantee supposes that the purchaser honors his financial commitments towards the seller.
Complaints or disputes will always be received with attentive benevolence, good faith being always presumed in the one who takes the trouble to expose his situation. In case of dispute, the customer will address in priority to the company to obtain an amicable solution.

Jurisdiction

By express agreement, between SAS MCB and the customer who accepts it without reservation or recourse as soon as he addresses, validates and pays his order to SAS MCB: the commercial act of sale is established and carried out at the head office of SAS MCB 97 RUE MAGENTA 69100 VILLEURBANNE, France, the customer's address being only the place of delivery which can in no case be considered as the place of the commercial transaction.
It follows from the above that only French law, to the exclusion of all others, is applicable to the commercial activity of SAS MCB.
In the event of a dispute concerning these general terms and conditions or any acts or situations arising therefrom, and in the absence of an amicable solution, when the contracting party is not a merchant, the claimant shall have the choice in contractual matters between the courts of Lyon, France or the court of the place of actual delivery of the goods.
